MyFoodTracker (the “Team”, “we”, “us”, or “our”) is a health management mobile application focused on food AI scanning, diet/weight tracking, and personalized nutrition insights, and is integrated with iOS Health Kit to realize health data synchronization. We are committed to protecting your privacy and personal data. This Privacy Policy explains how we collect, use, disclose, store and protect your information when you use our iOS mobile application and related services (the “Software and Services”), and outlines the rights and options available to you regarding your personal data.
The Software and Services include all core features of the App (e.g., food scan, diet/weight logging, nutrition analysis, Health Kit data synchronization) and any additional content or functions you choose to use ("Content"). IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY, DO NOT USE THE SOFTWARE AND SERVICES.
This Privacy Policy applies to all iOS users of the MyFoodTracker App, including free and premium subscription users, and complies with Apple App Store privacy guidelines and iOS data protection regulations.
Information Collection
The data we collect depends on your interactions with the Software and Services, your privacy settings, the features you use, iOS system permissions, and applicable local laws and regulations. We only collect necessary information to provide and optimize our services, and will never collect sensitive personal data without your explicit consent. The information we collect is categorized as follows:
I. Support Related Information
If you contact us via the App’s support section, email, or other official channels, we may collect your email address, username, and any information you voluntarily submit (e.g., support inquiries, problem descriptions, feedback details).
This information is only used to provide you with customer support services and will not be linked to your health data, user ID, or other usage data collected by the App. When you use the Software and Services, we automatically generate an anonymous internal User ID (which does not personally identify you) for your App usage, and this ID will not be associated with your support information.
II. Technical Information
We collect limited technical information about your iOS device and your use of the Software and Services to ensure the normal operation of the App and optimize your user experience. This information includes:
- Device-related data: iOS version, device model (e.g., iPhone 17 Pro Max), device configuration, anonymous device identifiers (e.g., IDFA, which can be reset by you in iOS settings);
- Usage-related data: App version, your configuration and settings of the App features, interaction records with core functions (e.g., scan, log, Health Kit synchronization);
- Network-related data: ISP (Internet Service Provider), anonymous IP address (processed to remove identifiable information), network connection type (Wi-Fi/cellular);
- Location data: Only collected if you enable location permissions in iOS settings, and used solely to optimize regional service experience (no precise location data is stored or shared).
III. User-Generated Health & App Core Data
This is the core data you voluntarily input, record, or generate through the App’s features, and is the key data for us to provide health management services. We collect this data only with your explicit confirmation and you can delete or modify it at any time in the App. The data includes:
- Food scan data: AI scan results of food (food name, calories, macronutrients), scan image URL, scan time (no image files are stored by us, only secure URL addresses);
- Diet/weight tracking data: Manually or automatically logged meal records (meal type, calories, macronutrients), weight records, target weight, daily/meal nutrition goals, and weight trend data;
- Health Kit synchronized data: Only collected if you authorize the App to access iOS Health Kit, including weight, steps, and other health data (the specific data type is subject to your authorization, and we will not access or collect any Health Kit data without your consent);
- Subscription data: Subscription type (free/premium), subscription validity period, and payment-related anonymous transaction records (no raw payment card information is stored; payment processing complies with Apple App Store payment guidelines).
IV. Feedback and Reviews
Any information you voluntarily provide to us, including App feedback, survey responses, product reviews, and suggestions for feature optimization. This information is used to improve the Software and Services and will be de-identified if used for product development.
How We Use Personal Data
We use the collected data only for the purposes stated in this Privacy Policy and will not use it for any unstated or unrelated purposes. All data usage complies with applicable data protection laws, iOS regulations, and Apple App Store guidelines. The main purposes of data usage are as follows:
I. Provide and Operate the Software and Services
We use your data to deliver the core functions of the App, including:
- Processing food AI scan results and displaying nutrition data for your reference;
- Storing your diet/weight records and generating personalized nutrition insights and weight trend analysis;
- Synchronizing data with iOS Health Kit (based on your authorization): Importing Health Kit data (e.g., weight, steps) into the App to enrich your health records, and optionally exporting App-generated diet/weight data to Health Kit (only with your explicit consent);
- Providing subscription service features (e.g., unlocking unlimited AI scans for premium users, managing subscription validity).
II. Optimize and Improve Products & Services
We use de-identified and aggregated user data (excluding any personal identifiable information or individual health data) to continuously optimize the App’s features and user experience, including:
- Fixing technical bugs and improving the accuracy of food AI scanning;
- Optimizing core features such as diet/weight logging and Health Kit synchronization based on iOS user usage habits;
- Developing new features that match iOS user needs (e.g., adding new nutrition analysis functions, optimizing Health Kit data integration);
- Improving the stability and performance of the App on iOS devices.
III. Comply with Applicable Laws and Regulations
We process and use data to fulfill our legal obligations and comply with local data protection, consumer protection, iOS regulations, and Apple App Store guidelines, including:
- Verifying user age to comply with children’s privacy protection laws (e.g., COPPA);
- Processing user data access and deletion requests in accordance with data protection laws and Apple’s requirements;
- Retaining necessary data for legal dispute resolution (if applicable).
IV. Provide Customer Support
We use your support-related information and de-identified App usage data to respond to your inquiries, solve technical problems you encounter (including Health Kit synchronization issues), and provide timely and effective customer support services.
Sharing Information with Third Parties
We take strict measures to protect your personal data and health information and will never sell, rent, or disclose your individual identifiable data or core health data to any third party for commercial purposes. We only share your information in the following limited scenarios, and all shared data is subject to strict confidentiality and security requirements, complying with iOS and Apple App Store guidelines:
I. Explicit Consent from You
We will only share your data with third parties if we have obtained your explicit written consent or authorization, and the sharing scope is limited to the content you have authorized.
II. Legal and Regulatory Requirements
We may disclose your data if required to do so by applicable laws, regulations, court orders, or administrative/investigative requests from competent government authorities.
III. Third-Party Service Providers for App Operation
We may share de-identified, non-personal data with third-party service providers who assist us in operating the Software and Services (e.g., cloud storage, technical support, payment processing, analytics). These third parties are only authorized to use the data for the specific purposes we assign, and are required to implement data protection measures no less stringent than those in this Privacy Policy and comply with iOS data protection requirements.
We will immediately terminate the partnership and pursue legal liability if a third-party service provider violates the data protection agreement and misuses or discloses your data.
IV. Third-Party SDKs Integrated in the App
The App integrates limited third-party SDKs that comply with iOS and Apple App Store guidelines to implement core functions and optimize user experience. All SDKs comply with relevant data protection laws and only collect the necessary technical data for their functions. The main third-party SDKs integrated are (update based on your actual SDKs):
- Cloud storage SDK: For secure storage of user data (encrypted transmission and storage, compliant with iOS security standards);
- Apple Payment SDK: For processing subscription payments through App Store (no raw payment data is stored by the App, fully compliant with Apple’s payment privacy guidelines);
- Analytics SDK: For de-identified App usage data analysis (to optimize product features, does not collect identifiable personal data);
- Push SDK: For sending non-intrusive App notifications via iOS Push Notification Service (e.g., check-in reminders, feature updates, with push permissions controlled by you in iOS settings).
Important Note: We never share your core health data (diet/weight records, food scan results, Health Kit synchronized data) with any third-party SDKs, advertisers, or other commercial entities.
V. Business Transfer (If Applicable)
In the event of a merger, acquisition, sale of all or part of our assets, or other business transfer, your data may be among the transferred assets. The acquirer or transferee will be required to honor all the commitments in this Privacy Policy and continue to protect your data in accordance with the same standards and iOS regulations. If the new owner changes the data usage policy, they will notify you and obtain your consent in accordance with applicable laws.
How We Store and Protect Your Personal Information
We take industry-leading technical and administrative measures to store and protect your personal data and health information, preventing unauthorized access, disclosure, alteration, or destruction of your data, and complying with iOS security standards and Apple App Store requirements. Our data storage and protection practices are as follows:
I. Data Storage
- Storage Location: User data is stored on secure cloud servers operated by qualified third-party cloud service providers (compliant with local data protection laws and iOS security requirements), and partial offline data (e.g., unsynced diet/weight records) is stored locally on your iOS device;
- Storage Format: Core business data (user ID, diet/weight records, subscription data, Health Kit synchronized data) is stored in structured encrypted relational databases (MySQL/PostgreSQL), and flexible data (nutrition goals, scan results) is stored in encrypted JSON format;
- Storage Period: We only retain your data for the period necessary to provide the Software and Services, or as required by applicable laws and Apple guidelines. You may request deletion of your account and all associated data at any time (see Your Rights and Options), and we will permanently delete your data (excluding data required to be retained by law) within the specified time after receiving your request;
- Local Data on iOS Devices: Offline data stored on your iOS device is encrypted, and you can clear all local App data at any time through your device’s settings (Settings → MyFoodTracker → Clear App Data). Uninstalling the App will delete all local offline data stored on your iOS device.
- Health Kit Data: We do not store any Health Kit data beyond the scope of your authorization; all Health Kit data synchronization follows Apple’s Health Kit privacy protocols, and revoking authorization will stop all data synchronization.
II. Data Protection Measures
- Encryption: All data transmitted between your iOS device and our cloud servers is encrypted via HTTPS. All stored personal data and health information is encrypted using industry-standard encryption algorithms (compliant with iOS security standards), and only authorized personnel have access to the encrypted data;
- Access Control: We implement strict role-based access control for our cloud server data, limiting access to your data to only the minimum number of authorized personnel necessary for App operation and customer support;
- Technical Security: We regularly update and patch our server and App security systems, conduct regular security audits and vulnerability scans, and prevent cyberattacks such as hacking and data breaches; we also follow Apple’s iOS security guidelines to ensure App security;
- Employee Training: All our employees receive regular data protection and privacy security training, and are bound by strict confidentiality agreements. Any violation of the agreement will result in serious disciplinary action and legal liability.
III. Special Protection for Sensitive Data
Your core health data (diet/weight records, food scan results, Health Kit synchronized data) is classified as sensitive data, and we take additional protection measures for this data:
- No raw sensitive data is shared with any third party;
- Sensitive data is never used for advertising or commercial promotion;
- Sensitive data is backed up regularly on secure, isolated servers to prevent data loss;
- Health Kit synchronized data is only accessed and used with your explicit authorization, and complies with Apple’s Health Kit privacy rules.
Your Rights and Options
Under applicable data protection laws, iOS regulations, and Apple App Store guidelines, you have the right to control your personal data and health information collected and used by us. We provide simple and easy-to-use ways for you to exercise these rights on iOS devices, and will respond to your requests in a timely manner. Your rights and corresponding operation methods are as follows:
I. Manage iOS Device Permissions
You can grant or revoke App permissions at any time through your iOS device’s settings (Settings → MyFoodTracker → Permissions), including:
- Camera permission: For food scanning;
- Photo Library permission: For accessing food photos for scanning;
- Health Kit permission: For synchronizing health data (you can modify the authorized data types at any time);
- Push permission: For receiving App notifications;
- Location permission: For optimizing regional services.
Revoking a permission will only limit the use of the corresponding feature and will not affect your use of other App features or the storage of your existing data.
II. Modify and Delete Local/Cloud Data
- You can modify or delete your diet/weight records, food scan history, and nutrition goals at any time in the App’s relevant feature pages;
- You can clear all local App data (including offline records) through your iOS device’s settings (Settings → MyFoodTracker → Clear App Data);
- You can revoke Health Kit authorization at any time (Settings → Health → Data Access & Devices → MyFoodTracker → Turn off permissions), which will stop all data synchronization between the App and Health Kit.
III. Request Account and Data Deletion
You have the right to request permanent deletion of your MyFoodTracker account and all associated data (including diet/weight records, food scan results, Health Kit synchronized data, subscription data). To exercise this right, please contact us via our official support email (see Contact Us), and we will verify your identity and permanently delete your data (excluding data required to be retained by law) within [e.g., 7] business days after receiving your valid request. Deleting your account will also terminate all synchronization with Health Kit.
IV. Request Data Portability
You have the right to request a copy of your personal data and health information in a commonly used, machine-readable format (e.g., CSV, JSON). To exercise this right, please contact us via our official support email, and we will provide the data copy to you within the time required by applicable laws after verifying your identity.
V. Update Your Personal Information
You can update your App username, avatar, contact information (for support), and privacy settings at any time in the App’s Personal Center page.
VI. Opt-Out of Non-Essential Data Collection
You can opt-out of the collection of non-essential technical data (e.g., App usage analytics) in the App’s Privacy Settings page. Opting out will not affect the normal operation of the App’s core features. You can also reset your IDFA in iOS settings (Settings → Privacy & Security → Tracking → Reset Advertising Identifier) to stop the collection of device-related tracking data.
Medical Disclaimer & Limitation of Liability
MyFoodTracker is a general wellness and self-management tool and is not a medical device as defined by the U.S. Food and Drug Administration (FDA), EU Medical Device Regulation (MDR), or any other national/regional regulatory body. The Software and Services are designed for informational and general wellness purposes only, and are not intended for any medical or clinical use.
I. No Medical Advice, Diagnosis, or Treatment
All content and data provided by the App (including food scan results, nutrition insights, weight trend analysis, Health Kit synchronized data, and any health-related suggestions) is for informational and educational purposes only. It does not constitute professional medical advice, diagnosis, treatment, or recommendation of any kind.
You must not rely on the App’s content to make health-related decisions. For any medical condition, symptoms, treatment options, or health concerns, you must always seek the advice of a qualified physician, registered dietitian, or other licensed healthcare provider. Never disregard professional medical advice or delay seeking it because of information you have read or interpreted from the App.
II. Not a Substitute for Professional Healthcare
The App is explicitly not designed, intended, or approved for:
- Diagnosing, curing, mitigating, treating, or preventing any disease, disorder, or health condition;
- Monitoring specific physiological or pathological states;
- Providing therapy or intervention intended to modify the structure or function of the human body;
- Serving as a substitute for clinical judgment or professional medical/nutritional care.
III. No Doctor-Patient or Professional-Client Relationship
Your use of the Software and Services does not create a doctor-patient, dietitian-client, therapist-patient, or any other healthcare professional-client relationship between you and us, our employees, or our partners.
IV. User Acknowledgment and Assumption of Risk
By using the Software and Services, you expressly acknowledge and agree that:
- You are using the App at your own risk;
- The App’s content and data are not a substitute for professional medical, nutritional, or healthcare advice;
- You are solely responsible for your own health decisions and any outcomes resulting from those decisions;
- Any actions you take based on the App’s content (e.g., adjusting your diet, changing your weight goals) are solely your responsibility;
- Health Kit synchronized data is provided for reference only, and we are not responsible for the accuracy of data from Health Kit.
V. Accuracy and Limitations of Data
While we strive to provide accurate, useful, and up-to-date wellness information and data, we do not guarantee the completeness, accuracy, reliability, or timeliness of any data, analysis, or content generated by the App (including food scan results, nutrition calculations, weight trend analysis, and Health Kit synchronized data).
Health and nutrition information is inherently personal and variable, and the App’s content and data may not be appropriate for your specific physical condition, dietary habits, or health goals. Food scan results are estimated based on AI recognition and may vary from the actual nutrition content of the food. Health Kit data is provided by iOS and third-party apps, and we do not guarantee its accuracy.
VI. Limitation of Liability
To the fullest extent permitted by applicable law, MyFoodTracker Team and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use the Software and Services, including but not limited to:
- Personal injury, illness, or death resulting from your reliance on the App’s content;
- Loss of revenue, data, or profits;
- Any damages resulting from technical failures, bugs, or service interruptions of the App or Health Kit synchronization;
- Any damages resulting from your misinterpretation or misuse of the App’s data and content;
- Any damages resulting from your failure to seek professional medical/nutritional advice;
- Any damages related to inaccurate or incomplete data from Health Kit.
Health Data & Wellness Purpose
All health and wellness data you input, record, or generate through the App (including food scan results, diet/weight records, nutrition goals, weight trend data, and Health Kit synchronized data) is used solely to provide you with general wellness insights and self-management tools. The core purposes of using this data are:
- Helping you track your daily diet and weight for personal wellness management;
- Providing personalized nutrition insights based on your logging behavior (for reference only);
- Synchronizing with Health Kit to integrate your health data for a more comprehensive view of your wellness status;
- Generating simple weight and nutrition trend analysis for your personal reference.
Important Note: The App is not a medical device, and the data and insights we provide are for informational and self-education purposes only. They are not intended for the diagnosis, treatment, cure, mitigation, or prevention of any disease or health condition. We do not provide any medical, nutritional, or healthcare advice. Always consult a qualified healthcare professional for any health or medical concerns. Health Kit synchronization is only for data integration and convenience, and does not constitute medical advice.
Children’s Policy
We strictly comply with the Children's Online Privacy Protection Act (COPPA) (U.S.), General Data Protection Regulation (GDPR) (EU), iOS children’s privacy protection guidelines, and other applicable children’s privacy protection laws and regulations.
- We do not knowingly collect personal information from children under the age of 13 (or 16 in the EEA and other regions where applicable). The Software and Services are not directed to children under this age;
- If we become aware that we have collected personal information from a child without the verifiable consent of a parent or legal guardian, we will immediately and permanently delete that information from our systems;
- If a parent or legal guardian becomes aware that their child has provided personal information to us without their consent, they may contact us via our official support email (see Contact Us), and we will take all reasonable steps to delete the child’s information from our files.
- The App does not request or collect Health Kit data from children, and complies with Apple’s children’s App guidelines.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our data practices, applicable laws and regulations, iOS guidelines, or App features. Any changes to the Privacy Policy will be posted on this page, and we will update the Last updated date at the top of the policy.
For material changes to the Privacy Policy (e.g., changes to data collection, use, or sharing practices, or changes to Health Kit integration), we will notify you through a prominent notice in the App (e.g., pop-up notification, in-app message) prior to the effective date of the changes, in accordance with applicable laws, iOS regulations, and Apple App Store guidelines.
Your continued use of the Software and Services after the effective date of the updated Privacy Policy constitutes your acceptance of the changes. We encourage you to review this Privacy Policy periodically to stay informed about our data protection practices.
